1.   Introduction

a.   These Terms of Service ("Terms") govern your use of the Ali At Home website, operated by Ali Hamilton Limited ("we", "us", "our"), and your purchase of products from us.

b.   By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

c.    Nothing in these Terms affects your statutory rights as a consumer.

a.    We operate this website using Shopify's ecommerce platform.

b.    While Shopify provides the technology that powers our online store, any contract you enter into for the purchase of goods is with Ali Hamilton Limited.

4.    Eligibiilty

a.    By placing an order you confirm that:

        i.    you are at least 18 years old, or have permission from a parent or guardian;

       ii.    the information you provide is accurate and complete; and

     iii.    you are authorised to use the payment method provided.

5.   Accuracy of Information

a.    We make every reasonable effort to ensure that information on our website is accurate and up to date. However, errors or omissions may occasionally occur. We reserve the right to correct any errors, inaccuracies or omissions and to update information or cancel orders where necessary, provided that doing so does not affect your statutory rights.

6.   Products

a.    We make every reasonable effort to ensure that product descriptions, images and pricing are accurate, however:

        i.    colours may vary depending on your device;

       ii.    handmade products may vary slightly;

     iii.    packaging may occasionally change; and

      iv.    we reserve the right to amend product specifications where necessary.

b.    Minor variations do not affect your statutory rights.

7.   Prices

a.    All prices are shown in Pounds Sterling (£).

b.    Prices include VAT where applicable unless otherwise stated.

c.    Delivery charges are shown separately during checkout.

d.    We reserve the right to change prices at any time, although changes will not affect orders already accepted.

8.    Placing Orders

a.    Submitting an order constitutes an offer to purchase.

b.    A contract is formed only once we send you an order confirmation email confirming acceptance of your order.

c.    If we cannot fulfil your order we will notify you and refund any payment made.

d.    Examples include:

        i.    products being unavailable;

       ii.    payment not being authorised;

     iii.    pricing errors; or

      iv.    suspected fraudulent activity.

9.    Payment

a.    Payment must be received before goods are dispatched.

b.    We accept the payment methods shown during checkout.

10. Delivery

a.    Delivery times are estimates only.

b.    We are not responsible for delays outside our reasonable control, including courier delays, severe weather or industrial action.

c.    Risk in the goods passes to you once they have been delivered to you or someone identified by you to receive them.

d.    Ownership of the goods remains with us until payment has been received in full.

11. Your Right to Cancel

a.    If you are purchasing as a consumer, you have the legal right to cancel your order within 14 days of receiving your goods under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

b.    To cancel:

        i.    email us before the 14-day cancellation period expires; and

       ii.    return the goods within 14 days of notifying us.

c.    Returned items must be unused and in a condition suitable for resale unless they have been inspected only to the extent necessary to establish their nature, characteristics and functioning.

d.    Refunds will be processed within 14 days of receiving the returned goods (or evidence that they have been returned).

e.    Refunds will be made using your original payment method.

f.     The following items are not eligible for cancellation unless faulty:

        i.    personalised products;

       ii.    bespoke products;

     iii.    sealed goods that are not suitable for return for health or hygiene reasons once opened; or

      iv.    any other products exempt under applicable legislation.

12. Faulty or Incorrect Goods

a.    Your statutory rights under the Consumer Rights Act 2015 are not affected if goods are:

        i.    faulty;

       ii.    damaged;

     iii.    not as described; or

      iv.    not fit for purpose,

please contact us as soon as reasonably possible.

b.    Where applicable we will repair, replace or refund the goods in accordance with your statutory rights.

13. Returns

a.    Our Returns Policy explains our voluntary returns process.

b.    Nothing in our Returns Policy limits your statutory rights.

14. Gift Cards and Promotional Codes

a.    Gift cards, promotional codes and discounts are subject to any additional terms issued with them.

b.    They may not be exchanged for cash unless required by law.

15. Intellectual Property

a.    All content on this website - including text, photographs, product descriptions, graphics, branding, logos and designs - is owned by or licensed to Ali Hamilton Limited.

b.    You may not reproduce, copy, distribute or commercially exploit any content without our prior written permission.

a.    Never leave candles unattended.

b.    Keep products away from children and pets where appropriate and use products only as intended.

      iv.    scrape or copy website content without permission; or

21. Limitation of Liability

a.    Nothing in these Terms limits or excludes liability for:

        i.    death or personal injury caused by negligence;

       ii.    fraud or fraudulent misrepresentation;

     iii.    defective products under applicable law; or

      iv.    any liability that cannot legally be excluded.

b.    Subject to the above, we shall not be liable for indirect or consequential losses that are not reasonably foreseeable.

a.    We shall not be liable for delays or failure to perform our obligations caused by events beyond our reasonable control, including:

        i.    natural disasters;

     iii.    flood;

      iv.    severe weather;

       v.    strikes;

      vi.    pandemic;

    vii.    government action;

   viii.    supply chain disruption;

      ix.    internet or telecommunications failures.

b.    We will use reasonable efforts to minimise any delay.

a.    We may update these Terms from time to time.

b.    The latest version will always be available on our website.

c.    Changes will not affect existing contracts already formed.

b.    If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.

c.    If we delay or fail to exercise any right under these Terms, this shall not prevent us from exercising that right at a later date.

d.    A person who is not a party to these Terms shall have no right to enforce any provision of these Terms pursuant to the Contracts (Rights of Third Parties) Act 1999.
